By accessing or using the Vipsac media transcoding and image optimization service ("Service") at https://vipsac.dev or https://api.vipsac.dev, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, you may not use our Service.
Vipsac provides a paid subscription API for media transcoding and image optimization. Our Service is provided on an "as is" and "as available" basis.
You agree to:
Vipsac makes no structural warranties regarding 100% continuous uptime or data throughput guarantees. The Service is provided without any warranties of any kind, either express or implied.
We enforce rate limiting of 5 requests per second sustained, with a burst capacity of 10 requests per second. Exceeding these limits may result in temporary suspension of your API access.
We enforce hard payload caps based on your subscription tier:

Attempting to exceed these limits may result in request rejection or account suspension.
All payments are processed through our third-party payment processor, Stripe. Subscriptions automatically renew every 30 days unless canceled. You may cancel your subscription at any time through your Stripe account settings.
Subscriptions automatically expire after 31 days unless renewed via Stripe payment lines. Upon expiration, your API access will be suspended until payment is received.
Vipsac reserves the right to suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you:
The Service and its original content, features, and functionality are and will remain the exclusive property of Vipsac and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIPSAC DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL VIPSAC, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
Vipsac shall not be held liable for any production downtime, service interruptions, or financial losses incurred by third-party applications or clients integrating our endpoints.
You agree to defend, indemnify, and hold harmless Vipsac and its affiliates, and their respective directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that your use of the Service caused damage to a third party.
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
